this is a question for the experts out there -

What does a victim of rape or sexual assualt have to go thru to get justice?

Please explain the process of reporting, evidence collection, litigation etc. Thanks.

di po ako expert, just to respond on this ang alam ko depende kung saan nangyari yong crimen. if its in the philippines, i know the victim have to go thru painful process. the victim will report the crime to the police, the police will make investigation to gather evidence and to make a good case. after this, a complaint will be filed at the fiscals office (prosecution) for preliminary investigation to determine probable cause, then an ifnromation will be filed in court for trial. on this process, the victim will suffer "double rape" because she have to open every single thing happened in open court, lalo na kapag ang defense ay mabusisi.  Sad

how do they gather the evidence? meron bang "rape kit" and mga local hospitals or clinics?

yeah matt have generalized the process

as to gathering of evidence, the police SOCO (scene of crime operations) is responsible on this. The PNP has its own unit called Crime Lab Unit, equipped with trained personnel and tools (instumentation) for crime scene processes...they have investigative kits. Sometimes, if the crime is sensational, the National Bureau of Investigation will be the leading agency for investigation.  Smiley

am wonderin what is their process for obtaining the evidence. Since DNA tests is not commonly used in the Philippines, how would they identify whose seminal fluid that is, that they swab from the victim?, or maybe from skin or body products found under the victims fingernails, assuming there was a struggle.  Roll Eyes

there are other tests applicable aside from DNA, mostly chemical reaction tests. For example seminal fluid, the test called "acid phosphatase reaction test" is applied.

also, we may not have DNA in the PNP service but the NBI has it (daw).


take note also that Filipino investigators are one of the best investigators in the world - they have the common sense and initiative. why? they can even make it appear that a red saliva is a semen NYA HA HA...and even convince the most intellectual judge that it is not "momma"...its a spermcell ur honor! NYA HA HA

Investigating and successfully prosecuting a crime of rape or sexual assault is no different from any other crime investigation. The victim files a complaint and be subjective to medical examination to determine if she had been sexually violated; the investigator investigate and hopefully arrest and charged the offender.  after finding a probable cause, the information is filed and the case goes on trial. Conviction is obtained if the evidence presented establish beyond reasonable doubt that the accuse has indeed committed the offense.

can i give a comment??  of course i can hehhehhe... joke lang..

anyway to be serious... medical examination is not the only basis of the rape case... as what he new rape law.... the mere inserting any kind of material to either in the anus, annal orifice or in tghe mouth is already considered rape... mouth cannot be a subject of medical examination in the case of rape? isnt it?... hehehehe... well, do u think the expert could find a cubic hair in the mouth...? hehehe aggggggain...
