I want to know who has the right for space.

Ex: I am walking at Session Rd. then I accidentally bumped a vendor who was selling peanuts. The vendor first of all has no right to sell her wares sitting in that particular area, much less a vendor's permit. She challenged me that it was my fault and I should pay for the spilt peanuts.

But I did not pay because it was her fault first of all who was blocking the pedestian sidewalk illegally. She challenged me to meet at the Barangay Hall to settle this but i decided to ignore. So I just left in a hurry because I knew I was correct and I was running out of time.

Do you think I was right? Or who is correct and wrong in this incident so I know what to do next time.

This is a situational case. Sidewalk vending is illegal per se as sidewalk belongs to the public.But there may be times when their selling thereat maybe legal. Case in point. During Christmas time, local government officials allow vendors to ply their wares in the sidewalk, subject to minimal tax. If you happened to damaged them by whatever reason, then I guess you are liable.

Am I liable? But the vendor on the street is an illegal vendor and has no right to ply his/her trade on that area.

Speaking of right of way u have the right of way because sidewalks are intended for pedestrians/commuters.,but you have the obligation to the things that you accidentally damaged whether he/she is a vendor or not..that's in my own opinion better consult an expert lawyer...

...ahhh what if the vendor is you ang they bump you...
...ang you know that you have no rights to sell your items in that place...
...the question is..
..will you ask that person to pay the cost of damage???
..will you make an arguement to him???
..what will you do??..

if i were the Vendor first i will not sell in the sidewalk alam kung illegal eh Law abiding kaya ako hehe..,ok considering that i am the vendor and someone accidentally bumped me and cause damaged to my goods,of course i will not argue him but instead i will talk the person with diplomacy co,z i dont believe that,in that case nothing can travels more swiftly scandal and i will let him understand my position and let him pay if he has the money,nobody wants that to be happen..the issue in this case is accidental hindi naman katangahan hehe pero in my side ang illegal lang naman ay ang pag tinda sa sidewalk at ang tinda ko ay hindi yun illegal at isa yang marangal na trabaho dahil pinaghirapan ko ang puhunan nyan...pero pag hindi sya magbabayad kahit may pera sya its ok ipagdasal ko nlng sya sana sa sunod sya na ang mabannga hehe.....JOWK!!!!
